Hadiya free to take decisions: SC
 
(New Delhi, Oct 3, 2017): The Supreme Court Tuesday said it will hear the plea of Shafin Jahan, husband of Hadiya, who converted to Islam, on October 9, reported PTI.

The apex court will then examine whether the Kerala HC can exercise its writ powers and annul the marriage of 24-year-old Hadiya.

As per TV reports, Chief Justice Dipak Misra questioned how the SC (under Justice Khehar) had asked for a NIA (National Investigating Agency) probe in the case.

The CJI has been quoted as asking how the Kerala HC can annul a Hindu-Muslim marriage. He said, "A 24-year-old can't be kept confined by her father."

Earlier, a group of people had submitted a petition to Chief Minister Pinarayi Vijayan demanding a probe into the alleged unlawful incarceration of Hadiya, the 24-year-old Vaikom native who converted to Islam.

After annulling her marriage with Shafin Jahan, the Kerala High Court sent Hadiya with her parents K.M. Asokan and Ponnamma around four months ago. The case is under consideration of Supreme Court now, which has ordered a NIA investigation into the case.

The apex court had been hearing the plea seeking to not take over the Kerala Love Jihad case by the NIA.

Shafeen Jahan, the husband of a woman in the Kerala Love Jihad case, on September 16 filed a plea requesting the apex court to call off the NIA probe, alleging that the investigation agency "is not being fair".

Earlier in August, in compliance with the orders of the top court, the case was re-registered by the NIA and an investigation was taken up.
